 Warranty Terms and Conditions

A LOT MORE DETAILS

This warranty shall extend only to the original purchaser and is non-transferable. Corporate or contract purchases, floor samples, or any use of the furniture for the general public are not covered by this warranty.

Please be advised that failure to follow the conditions listed in the care section of our warranty could result in limitations to the coverage.

FABRIC- FIVE YEAR LIMITED WARRANTY

The fabric warranty is valid only if our cleaning method is followed. Failure to follow the procedures voids any claim to the fabric portion of this warranty. The manufacturers of upholstery fabrics do not guarantee and will not assume responsibility for any fabric’s color fastness, wearing qualities, or dyelot variations. One For Victory therefore makes no warranties, expressed or implied, regarding its fabrics. We do not cover application of a soil resistant treatment. There are certain characteristics that make a fabric unique, such as color variation, slubs, natural fabrics and strié designs. These characteristics are not considered a fabric defect.

Color change: Most fabric will gradually change color over time due to the sun, heat, indoor lighting and air quality. There are certain steps you can take to minimize the effect, although it is not possible to completely eliminate it. These include: 

• Applying tint or UV film to windows to stop sunrays from hitting the furniture 

• Periodically rearranging the furniture 

• Rotating cushions on the furniture 

• Purchasing items upholstered in the same fabric at the same time so they change in color in sync

Wear: Most woven fabrics will show wear due to friction from se. One type of wear is pilling, where little balls of fuzz are formed on the surface of fabric. Pilling happens when non-structural fibers work their way out of the fabric and ball up. Pilling can occur with normal use, and is not considered a manufacturing defect. There are several factors that can affect the amount of pilling such as type of fiber, the weave, the construction of the fabric, and application of the fabric.

LEATHER - FIVE YEAR LIMITED WARRANTY

The leather warranty is valid only if our cleaning method is followed. Failure to follow the procedures voids any claim to the leather portion of this warranty. Determination of improper cleaning rests with the leather supplier. Variations in shade, texture, and natural markings caused by abrasions during the life of the animal are not considered defects but are all qualities of fine leather. Natural markings such as healed scars, stretch marks, and wrinkles are characteristics that enhance the individuality of each piece and ensure that you are purchasing authentic leather. To preserve the natural beauty of your furniture, avoid chemicals, direct and indirect sunlight, and strong lighting, as they will damage and fade leather. Fading is not covered under this warranty.

Our leather is warranted for five years from the original retail purchase date against the following, provided you adhere to the care instructions listed on the leather care page:

CROCKING - There will be no transfer of color.

PEELING - The finish will not peel from the leather.

FLEXIBILITY - The leather will not become hard except under extremely hot or cold climate conditions.

BREAKING STRENGTH - The leather will not tear under normal use.

FRAME CONSTRUCTION - FIVE YEAR LIMITED WARRANTY

Our frames are constructed of select hardwood and hardwood composites, all of which have been carefully kiln-dried, milled and processed to remove defects which could cause structural weakness. Each corner is reinforced with corner blocks and braces which are firmly glued and stapled in place. The result is a frame with inherent strength that One for Victory warrants against defects in material and workmanship for the life of the product under normal use.

SEATING SUSPENSION - FIVE YEAR LIMITED WARRANTY

One for Victory utilizes Sinuous Spring seating suspension. The use of this high-quality type of seating suspension results in the proper distribution of support evenly for uniform seating comfort that provides exceptional seating alignment and comfort. One for Victory warrants this construction against defects in materials and workmanship for the life of the product under normal use.

CUSHION CONSTRUCTION - FIVE YEAR LIMITED WARRANTY

One for Victory Polyurethane Foam Cushions are constructed with heavy-density, high-support polyurethane foam center with a layer of a low-density, high-resilience polyurethane foam pad laminated to the top and front providing a crowning effect to the seat.

One for Victory Down & Feather Cushions are produced utilizing a high-density polyurethane foam center core with a polyester fiber pad laminated to the top, front and bottom providing a crowning effect to the seat. the envleope is filled with a blend of 50% down and feather and 50% polyester fiber.

A softening of the foam should not be confused with a loss of resilience. All polyurethane foam will soften as a result of normal use and should not be considered a defect. Our polyurethane foam and down & feather cushions are warranted against pancaking and concaving and feather leakage for five years from the original retail purchase date under normal use. This warranty does not cover furniture previously used as floor samples and any furniture purchased for public use.

MECHANISMS- ONE YEAR LIMITED WARRANTY

One for Victory Collection utilizes top quality mechanisms to provide the additional benefit of highly reliable, multi-function upholstered furniture. We warrant all moving mechanical parts against defects in material and workmanship under normal use for a period of one year from the original retail purchase date.

ALL OTHER COMPONENTS - ONE YEAR LIMITED WARRANTY

All components not specifically mentioned/covered in our warranty has a one-year warranty from the date of sale. This includes but is not limited to; thread, zipped, decking, dust cover, etc. We warrant all components against defects in material and workmanship under normal use from the original retail purchase date.

WARRANTY SERVICE PROCEDURE:

Claims must be made through the furniture retailer from which the furniture was originally purchased. The furniture retailer will contact One for Victory or warranty service. Warranty registration and evidence of original purchase (such as invoice or original sales slip) will be required. This warranty is limited to the original purchaser and is non-transferable.

One for Victorys liability under this warranty is limited to repairing or replacing at One for Victory Collection’s option any part or parts of the product found to be defective in material or workmanship. One for Victory in its sole discretion will determine the cause and nature of any defect, the necessity and manner of repair or replacement, and all other matters pertaining to the condition of the furniture.

One for Victory reserves the right to inspect the product at our facility, should inspection become necessary. The furniture must be cleaned prior to returning the facility and the cost of packing and shipping to and from the facility are not covered by the warranty.

If exact goods are not available, One for Victory reserves the right to use like goods of equal quality for repair or replacement. One for Victory will not be responsible for any labor charges resulting from a non-warranty related repair. In no instance shall One for Victorys obligation exceed the original cost to the retailer. Repair, if required, may take several months to complete.

SALES REPRESENTATIVE INSPECTION POLICY:

Should it become necessary for our sales representative to inspect the merchandise, the customer must arrange to have the furniture at their warehouse for inspection. If it is impossible to get the furniture to the warehouse, and a representative must go to a consumer’s home, an authorized representative of the retail store must accompany our sales representative. No exceptions will be made. In no instance is a One For Victory representative authorized to go to a consumer’s residence unaccompanied.

CANCELATIONS AND RETURNS

Cancelations and returns are not permitted on special order products with few exceptions. Non-special order merchandise may not be returned without prior authorization from One For Victory. Request consideration to return a product, please contact Customer Service Department for assistance. Returns must be made within 7 days of receipt. No credits or allowances will be given for repairs made without our prior written authorization. Unauthorized deductions will be charged back.

LOCAL REPAIRS

Charges for local repairs will not be accepted unless an estimate is submitted to the Customer Service Department for authorization. No credits or allowances will be given for repairs made without prior written authorization from an authorized factory representative. Unauthorized deductions will be charged back.

SHIPPING

All orders ship FOB San Diego, CA, Costa Mesa, CA, or Hickory, NC via the freight carrier specified by the customer. For the safest transport of the furniture pieces, One For Victory suggests that all customers ship with a designated furniture carrier, rather than a common carrier, whenever possible. One For Victory is not responsible for the transit time from our warehouses to your location. With a proven track record, One For Victory will be here to honor our warranty promises long into the future.

All items must be inspected for damage prior to signing the bill of lading for the shipment and releasing the driver. The designated carrier will not accept claims for freight damage unless the damage is described on the shipper’s bill of lading at the time of delivery. It is the responsibility of the receiving warehouse, interior designer, or end-user to be present at the time of delivery to inspect the pieces prior to signing the bill of lading.

Please be advised that you must file freight claims immediately and directly with the carrier. One For Victory is not responsible for filing freight claims. To file a claim, you will need the invoice, bill of lading, and the freight bill you received from the carrier on delivery. An agent of the freight carrier will inform you on how to complete the claim form. It is absolutely imperative that you do not destroy or discard any original packaging.

FILING FREIGHT CLAIMS

Freight claims must be filed immediately, and directly with the carrier. One For Victory is not responsible for filing freight claims. To file a claim, you will need the invoice, a bill of lading, and the freight bill you received from the carrier on delivery. DO NOT DESTROY OR DISCARD ANY ORIGINAL PACKAGING. DELIVERY POLICY All orders are shipped freight collect, FOB San Diego, CA, Costa Mesa, CA or Hickory, NC. Customers are responsible for choosing a carrier, setting up pick-up and delivery, and handling all freight charges. One For Victory does not drop-ship and will not ship to locations other than a retailer’s warehouse or store.

LOST OR DAMAGED MERCHANDISE

Our furniture is packed in accordance with specifications established for furniture moving in interstate commerce. Our responsibility ceases when goods are signed for “in good order” by the transportation company, and all claims for freight overcharge, loss in transit, or damage in transit must be handled with the carrier. The bill of lading is an acknowledgment by the transportation company of receipt in good condition of the shipment covered by our invoice. If any of the goods called for on the bill of lading are short or damaged, do not accept them until the freight agent makes a damaged and/or shortage notation on your freight bill. If you choose to receive the merchandise, be sure to sign the bill of lading with the exceptions noted. Claims for damage must be filed immediately with the freight company. Be sure the furniture is unpacked and inspected to have a valid claim. If your shipment consists of more than one piece or carton, and the carrier fails to deliver an item, have an agent make a shortage notation on your freight bill before signing it, or paying freight if freight collect. If any concealed loss or damage is discovered as the shipment is inspected, notify your local agent at once and ask him/her to inspect. Hold all packing materials until inspection has been made, and have a delivery copy available. Unless you do this, the transportation companies may not entertain any claim for loss or damage. (Friction rubs, cracked frames, and broken legs are good examples of concealed damage.)

ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE EXPRESS WARRANTIES ON THIS PRODUCT. THE WARRANTIES AND REMEDIES SET FORTH IN THIS LIMITED WARRANTY ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL OR WRITTEN, EXPRESS OR IMPLIED. IN NO EVENT WILL ONE FOR VICTORY BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE THIS PRODUCT.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE SALE, PURCHASE, OR USE OF THE PRODUCT INCLUDING ANY CLAIMS UNDER ANY WARRANTIES, SHALL BE SETTLED BY ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS SUPPLEMENTARY PROCEDURES FOR CONSUMER-RELATED DISPUTES ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. THE PLACE OF ARBITRATION SHALL BE ORANGE COUNTY, CALIFORNIA.
